Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WhizzRent platform (the “Service”), operated by [COMPANY NAME] (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms.
1. Definitions
- Service: the WhizzRent web application, mobile applications, APIs, and related infrastructure.
- Organisation: a property-management entity (landlord, company, or sole trader) that has registered for the Service.
- User: any individual using the Service - including organisation owners, staff, caretakers, and tenants.
- Customer Data: all data, content, and information uploaded to, processed by, or generated within the Service for or on behalf of an Organisation.
2. Account registration + eligibility
To use the Service you must be at least 18 years old and able to enter into a binding contract. Organisations are responsible for ensuring their staff and tenants use the Service in line with these Terms.
You agree to provide accurate information when registering and to keep it updated. You are responsible for safeguarding your account credentials. Where MFA is available we strongly recommend you enable it; for sensitive roles MFA may be required by your Organisation administrator.
3. Plans, fees, and payment
Organisations subscribe to a plan published on our pricing page. Fees are billed monthly in advance unless otherwise agreed in writing for Enterprise customers.
M-Pesa transaction costs: Safaricom's standard M-Pesa transaction charges apply to each payment made through STK Push or paybill. WhizzRent does not take a cut of your rent collections - money lands in your account directly.
Failure to pay subscription fees may result in suspension of the Service. We will provide reasonable notice before suspension.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorised access to any part of the Service or other Organisations' data
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with the Service's operation (rate-limit evasion, denial-of-service)
- Use the Service to harass, threaten, or harm tenants, landlords, or staff
- Upload malware, viruses, or any malicious code
- Misrepresent your identity or affiliation with any person
- Use the SOS feature for non-emergency purposes
5. Customer Data
You retain all rights, title, and interest in your Customer Data. By using the Service you grant us a limited licence to process Customer Data solely to operate the Service for you.
We use database-level isolation to ensure your Organisation's data is not accessible to other Organisations. See our Privacy Policy for how we collect, use, and protect personal data.
6. Tenants and end users
Tenants access the Service through tenant accounts created by their landlord or property manager. Tenants are end users of the Service; the landlord / property manager is the contracting Organisation responsible for the tenant's use.
Tenants may exercise their data-protection rights from the privacy page in their account or from the mobile app. A request opens a case that the Organisation decides, category by category; nothing is carried out until it has, and the tenant is given an answer stating what was actually done. Erasure and anonymisation are different acts and are decided separately: one destroys data the Organisation is not required to keep, the other keeps the record and removes the identity from it.
7. SOS emergency feature
The SOS feature is provided as a property-management escalation tool - it notifies the responsible parties at your Organisation (caretakers, property managers, emergency contacts). The SOS feature is NOT a substitute for emergency services (police, ambulance, fire brigade).In a life-threatening emergency, call 999 or the appropriate Kenyan emergency number immediately.
8. M-Pesa Daraja integration
WhizzRent integrates with Safaricom's M-Pesa Daraja API to process payments. Use of the Daraja API is subject to Safaricom's own terms. WhizzRent is not responsible for outages, delays, or errors originating from Safaricom's systems.
9. Service availability + support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance where possible. For paid plans, support is available via the contact form during business hours (Mon–Fri, 9am–6pm EAT).
10. Intellectual property
The Service, including all software, design, trademarks, and content (excluding Customer Data), is owned by us or our licensors. You receive a non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
11. Disclaimers and limitation of liability
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied.
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages, including lost profits or lost data.
This does not limit liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, fraud, or any other non-excludable liability).
12. Indemnification
Each Organisation agrees to indemnify us against claims arising from (a) the Organisation's breach of these Terms; (b) the Organisation's misuse of tenants' data; or (c) any unlawful conduct by the Organisation or its staff using the Service.
13. Termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts for breach of these Terms, non-payment, or to comply with legal obligations.
On termination, you may export your data in machine-readable format for 30 days, after which Customer Data will be deleted (subject to retention for legal / audit purposes - see our Privacy Policy).
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of [Nairobi, Kenya], subject to mandatory consumer-protection provisions where applicable.
